Supplemental Meta Portal Privacy Policy

Meta Portal and Portal-branded devices (“Meta Portal devices”) and any Meta Portal or Portal-branded websites, applications, and other products and services (along with the Meta Portal devices, the “Meta Portal Products”) are platforms that help you connect with family and friends, share content and experiences with the people you care about and discover photos, music, videos and other content. Meta Portal Products are Meta Products and are available to users who have an active and valid Facebook, WhatsApp and/or Workplace account. The Meta Privacy Policy (available at www.facebook.com/policy/) describes the information that we process to support Meta Products (as defined in the Meta Privacy Policy and available here), including Meta Portal Products and Meta Products available on Meta Portal, such as Facebook Watch from Meta and Messenger. This Supplemental Meta Portal Privacy Policy supplements the Meta Privacy Policy by explaining the additional information that we process to support Meta Portal devices and providing more detail about how we process that information.

What information do we collect?
  • In addition to the information described in the Meta Privacy Policy under "What information do we collect?", Meta Portal devices collect the following categories of information when a Meta Portal device is used:
    • Camera and audio information: When a Meta Portal device's camera and microphone are on, which you can control, we collect camera and audio information, including the following:
      • Technical information. When using a Meta Portal device's camera or microphone to make a call, we collect technical information, such as volume level, number of bytes received or frame resolution. Meta does not listen to, view, or keep the contents of calls on your Meta Portal device unless a Meta Portal device specific wake word is detected or the microphone button is pressed (if your device supports a microphone button) during these calls. In these cases, the Meta Portal device may record background conversation or other ambient noise, as described in "Voice interactions" below.
      • Smart Camera. Meta Portal devices' Smart Camera technology automatically pans and zooms to keep everyone in frame while the Meta Portal device is being used. When the camera and microphone are on, a Meta Portal device processes, on the device only, information to keep you and others in frame, such as how many people are in view of the camera and where they are in relation to the camera and microphone. This information is sent to Meta only as summary statistics for improving the Smart Camera, or as part of the automatic crash logs described below or where you choose to do so, such as by filing a bug report.
    • Voice interactions. Where available, you activate voice services on a Meta Portal device by using a Meta Portal device specific wake word (i.e. words you use to talk to Meta on a Meta Portal device), a third-party-specific wake word (i.e. words you use to talk to a third-party voice service on a Meta Portal device) or, for devices that use a microphone button, by pressing the microphone button. Unless you turn a Meta Portal device's microphone off, the Meta Portal device listens for a wake word. If the Meta Portal device detects a wake word, a visual indicator appears on the bottom of the screen. If a Meta Portal device specific wake word is detected, we process audio recordings, transcripts, and related data (such as the hardware version of your device and the length of the audio related to your interaction) about your voice interactions to respond to your request, provide the requested service to you, and, depending on your settings, improve our voice services. Voice interactions are what you say when using our voice services, including when voice services are mistakenly invoked, as well as background sound that can be heard once voice services are enabled. Depending on your settings, you can view, hear and delete stored information about your voice interactions, and you can manage voice storage in your settings.     • Environmental data: We use device sensors to collect environmental data from and about Meta Portal devices, such as ambient light, when the device is on.
    • Device performance and reliability: We collect information about Meta Portal devices' performance and device attributes, including crash reports, system logs and settings, and third-party service usage when the device is on. Similar to other devices, when a Meta Portal device experiences a crash, a log about the crash is sent to Meta that may include small fragments of information from camera and microphone amongst other information (such as contact information) in use at the time of the crash. These crash logs are only retained and used to diagnose and fix problems with Meta Portal devices or other apps and services used on Meta Portal devices.
    • Information and content provided to Meta Portal devices: We collect information that you provide directly to a Meta Portal device, such as names and contact information. We also collect content created while using a Meta Portal device's features, including photos, videos, and drawings to provide these features.
    • Third-party services: When a third-party service is used on a Meta Portal device, we collect information about the use of the service, including how often and for how long it is used, crash log information when it crashes and an authorisation token, if it requires a log in. Some third-party services share information with us when the service is used on a Meta Portal device. For example, when a third-party music integration is used, they transfer information, such as song name to us when that song is played on your Meta Portal device. How do we use this information?

In addition to the uses of information described in the Meta Privacy Policy under "How do we use your information?", Meta Portal devices use the information that we collect in the following ways:

  • Detect engagement with a Meta Portal device. We use the information that a Meta Portal device collects to automatically detect interactions with the device. This empowers the Meta Portal device to do things such as wake automatically when its camera detects movement.
  • Regulate your Meta Portal device. We use environmental and device performance data to help regulate and enhance the performance of your Meta Portal device. For example, automatically controlling the device temperature and screen brightness.
  • Improve performance and reliability. We use device performance and reliability data to help improve Metadevices and products. By analysing device performance and reliability, we can improve the hardware and software that powers your experiences with Meta, including on Meta Portal devices.
  • Offer and improve voice services. Meta Portal devices automatically detect a Meta Portal device specific wake word so that it can respond to voice commands. If your Meta Portal device is connected to a Facebook account, depending on your settings, we analyse and review information about your voice interactions using human and machine processes to improve, troubleshoot and train our speech recognition systems, to maintain the integrity of our products and to promote safety on and off our platform. How is this information shared?

In addition to the sharing of information described in the Meta Privacy Policy under "How is this information shared on Meta Products or with Integrated Partners?" and “How do we share information with Partners, vendors, service providers and third parties?”, Meta Portal devices share the information we collect in the following ways:

  • Owners with whom you share your Meta Portal device. If an Owner (as defined in the Supplemental Meta Portal Terms of Service) chooses to add one or more Owners to a Meta Portal device, each Owner may be able to access and delete certain information (such as recordings and transcripts of voice interactions), even if that information is from another Owner or others who have access to the Meta Portal device. Each Owner can also change Meta Portal device settings and add or remove Owners from your Meta Portal device. If an Owner is removed from a Meta Portal device or deletes their account, information associated with that Owner may still be accessible to others who have access to your Meta Portal device, including voice interactions and access to a third-party service connected to that Owner.
  • People who have physical access to your Meta Portal device. Anyone who has physical access to your Meta Portal device and Meta Portal device passcode (if enabled) can access certain information on the Meta Portal device, such as the contacts of Owners, their availability, and their photos or videos, as well as make audio or video calls. You should also consider situations when people may be able to see the content that is displayed on your Meta Portal device (for example, when somebody walks past when your photographs are being displayed on your Meta Portal device).
  • Third parties for product improvement and legal compliance. If your Meta Portal device is connected to a Facebook account, we share recordings, transcripts, and related data about your voice interactions with vendors and service providers who assist us in improving, troubleshooting and training our speech recognition systems. We may also share information about your voice interactions with third parties where we have a good faith belief that the law requires us to do so.
  • Third parties to facilitate use of third-party services on Meta Portal devices. When third-party services are used on your Meta Portal device, we share information with these third parties about your Meta Portal device, such as device name, IP address and postcode, as well as other information to help them provide the requested services. For example, when you use a Meta Portal device specific wake word to request a third-party service, we may share the transcript or subject of your request with that third party. These third-party services can also collect information directly from your Meta Portal device, including device information and information about use of their service (e.g. the songs you listen to), as well as any other information you choose to share with them (e.g. your Facebook profile information if you log in to the third-party service using your Facebook account). If a third-party voice service is used on a Meta Portal device that is activated by a wake word that is specific to that service, voice information will be processed by that third-party voice service, not Meta. The information collected by these third-party services is subject to their own terms and policies, not this one.
How can you exercise your rights provided under applicable data protection law?

Under applicable data protection law, you have the right to access, rectify, port and erase your data, and to object to or restrict certain processing of your data that we collect through Meta Portal devices. We collect, use and share your data in the ways described above in accordance with the Meta Privacy Policy under “What is our legal basis for processing your data, and what are your rights?”.

  • We will process your data for the purposes indicated under the section “How do we use this information?” of this policy as necessary to fulfil the Supplemental Meta Portal Terms of Service and the Meta Terms of Service
  • We specifically rely on our legitimate interests to:
    • process transcripts, audio recordings, and related data about your voice interactions to improve our voice services, in accordance with your choices. It is in our legitimate interest to use this information in this manner to improve our voice services;
