  2. Scope: This Warranty covers Meta-manufactured products in the original packaging, purchased from Meta or an authorised consumer retailer or commercial reseller (collectively, "Authorised Sellers") in the Supported Countries (each, a "Product"), provided that they:

    1. are used per Meta's product documentation and published guidelines (including technical specifications) ("Documentation");

    2. are new or refurbished by Meta or a Meta-authorised third party (excluding products provided under our Out of Warranty Programme (terms at meta.com/legal/out-of-warranty) (each, a "Refurbished Product"); and

    3. have a defect in materials or workmanship that, under normal use, prevents the Product from functioning substantially in accordance with the Documentation ("Warranted Functionality"). Product functionality and services may vary by location.

    This Warranty is subject to the exclusions and limitations below. We will provide Meta software or services necessary for the Warranted Functionality during the warranty period (see Section 3), or as legally required, and may update, modify or limit such software and services at our discretion, provided that we maintain (or exceed) the Warranted Functionality. Refurbished Products may have some minor cosmetic imperfections which are not covered by this Warranty. Authorised consumer retailers listed at meta.com/retailers. For authorised commercial resellers, contact the designated sales representative or visit work.meta.com.

  3. Duration: This Warranty applies for one year from purchase or delivery of the Product (whichever is later), as shown by valid proof of purchase (e.g. receipt or invoice). For repaired or replacement Products, coverage continues for the longer of:

    1. the remainder of the original warranty period;

    2. 90 days from delivery of the repaired or replacement Product; or

    3. any longer period required by law.

  4. Who can bring a claim: You may bring a claim under this Warranty if you:

    1. purchased or are the gift recipient of a Product purchased from Meta or an Authorised Seller, in a Supported Country; and

    2. your claim meets this Warranty's requirements.

  5. How this Warranty relates to applicable laws: This Warranty is a voluntary manufacturer's warranty, offering rights in addition to, and/or separate from, those provided under applicable laws, including consumer laws in the relevant Supported Country. You may choose to bring a claim under this Warranty or applicable consumer laws. This Warranty does not affect your consumer law rights, and its terms do not apply to claims brought under such laws. For more information, visit meta.com/legal/rights-under-consumer-laws.

  6. Remedies: If your claim is covered by this Warranty, we will, at our choice:

    1. repair or replace the Product to meet the Warranted Functionality and return it at our cost; or

    2. provide a full or partial refund (e.g. partial for bundled Products or accounting for use while the Product met the Warranted Functionality) if we determine that repair or replacement is impossible or not otherwise appropriate (e.g. it cannot be performed within a reasonable time). On refund, the Product becomes Meta's property and we may require its return.

    Replacements may be new, refurbished or remanufactured, or a different Product with equivalent Warranted Functionality. Replacements become your property; the replaced Product becomes Meta's property. See Section 8 for claim instructions. The term "Product" in this Section includes its parts.

    1. loss of data. You are responsible for backing up data regularly, and we do not warrant, represent or undertake that data will be preserved on any repaired or replacement Products;

    2. losses not caused by our breach of this Warranty;

    3. loss or damage that was not a reasonably foreseeable consequence of our breach of this Warranty (i.e. an obvious or known possible consequence of our breach at the time of purchase); or

    4. business losses, including lost profits, business interruption, data loss or lost business opportunity.

    This Section shall not apply to:

    1. death or personal injury resulting from our negligence;

    2. fraud or fraudulent misrepresentation; or

    3. any liability that cannot be limited or excluded under law.

  14. For consumers in France, the rights mentioned in Section 5 of this Warranty include:

    1. the legal guarantee of conformity; and

    2. the legal guarantee for hidden defects.

    For more information on these two statutory warranties, please visit meta.com/legal/terms-of-sale.

  15. For consumers in Poland, the following terms will apply:

    Section 3 above is replaced by the following clause:

    This Warranty applies for one year from the date of purchase of the Product, as documented by valid proof of purchase (e.g. receipt or invoice).

    If we provide significant repairs or replace a Product under this Warranty, the repaired or replacement Product will be covered by this Warranty for the original warranty period recommenced from the moment of delivery of the replacement Product or return of the repaired Product or 90 days following the delivery date of the repaired or replacement Product, whichever is longer.

    Section 6 above is replaced by the following clause:

    If your claim is covered by this Warranty:

    You may choose whether you want to repair or replace the Product so that the Product (or its part) meets the Warranted Functionality and we will return the repaired or replaced Product (or part) to you at our cost.

    We may replace the Product when you request repair or repair the Product when you request replacement if bringing the Product into conformity with the Warranted Functionality in the manner chosen by you is impossible or would involve excessive costs.

    If repair and replacement are impossible or would involve excessive costs, we may provide a full refund of the purchase price you paid for the Product or provide a partial refund (e.g. because the Product was sold in a bundle, or taking into account any period of use by you during which the Product met the Warranted Functionality).

    If we provide a refund for the Product, then the Product becomes the property of Meta at the time you receive the refund and we may decide not to return the Product to you.

    If we replace a Product (or part):

    1. the replacement may be new, refurbished or remanufactured, or a different Product (or part) that has similar functionality to the original Product (or part), which meets the Warranted Functionality; and

    2. the replacement becomes your property, and the replaced Product (or part) becomes Meta's property.
