Supplemental Meta Platforms Technologies Privacy Policy Legal Bases for Meta VR Products

We collect, use and share your data in the ways described in accordance with the Meta Privacy Policy under the “What is our legal basis for processing your information, and what are your rights?” section.

In the Supplemental Meta Platforms Technologies Privacy Policy, we explain the additional information we process to support Meta VR Products under the “What information do we collect for Meta VR Products?” section and provide more details about how we process this information under the “How do we use your information for Meta VR Products?” section. We also specify the categories of recipients with whom we share personal data in the section entitled “How is your information shared with others for Meta VR Products?”

Our Legal Bases for Processing Personal Data

Our legal basis for collecting and using the personal data described in the Supplemental Meta Platforms Technologies Privacy Policy will depend on the personal data concerned and the specific context in which we collect it. However, we will normally collect personal data from you only:

  • where we need such personal data to perform contractual obligations to you (or take steps at your request prior to entering into a contract with you); or

  • where the processing is in our legitimate interests and not overridden by your rights and freedoms. If we collect and use your personal data based on our legitimate interests (or those of any third party), such interests generally will be as specified in the table further below. We may have other legitimate interests, which we will make clear to you at the relevant time, as applicable.

When we process data that you provide to us based on your consent, you have the right to withdraw your consent at any time and to port that data you provide to us, under the GDPR. To exercise your rights, visit the Meta Quest Privacy Centre. Your withdrawal of consent will not affect the lawfulness of processing that takes place prior to your withdrawal.

In some instances, we may also need to process personal data to comply with a legal obligation or may otherwise need personal data to carry out a task in the public interest or protect your vital interests or those of another person. Purpose: Providing the Meta VR Products, including their functions

This also includes ensuring that the Meta VR Products operate in accordance with how they were described to you, for example, that they operate as described and, where applicable, that their functions are personalised to your use

Legal basis: Contractual necessity pursuant to (and in accordance with) our Terms of Service

To the extent you are under the age of majority (under 18, in most applicable countries) and have limited ability to enter into an enforceable contract, we rely on our legitimate interest to provide the Meta VR Products

  • Information you provide when you interact with the Meta VR Products (including their features), including information about your use of the Meta VR Products. For example, payment credentials that you provide to us, your virtual reality activity, the apps you download, the events you attend, the purchases you make, and the frequency and duration of your activities on the Meta VR Products

All Meta VR Products users

  • Content you create, such as a picture you post, an object you build, and information about this content, such as the date and time you created the content

  • Technical system information about the devices you use and information about how you use Meta VR Products, such as performance and device attributes, system logs and settings, success or failure of specific functions and crash reports (which include date and time of the crash, your user ID, device ID, IP address, and small fragments of information from any camera and microphone in use at the time of the crash)

  • Information about the use of third party services you access using the Meta VR Products, including how often and for how long they are used, crash log information when they crash, and an authorisation token, if they require a login

  • Information you provide when you create a Meta account, including your name, contact information, password and date of birth

  • Information you provide when you create a Meta Horizon profile, such as your profile name, profile picture, username, avatar, list of followers and interactions with games and apps

Users of Meta VR Products that activate features that, in order to function properly, need to collect environmental data and dimensions in order to work (for example: information about the size of walls, surfaces and objects in your room and the distances between them and your headset to offer experiences that blend your virtual and real-world environments)

Purpose: To power social features and personalise and promote content in connection with the Meta VR Products

Users of Meta VR Products that use features such as Meta Quest's hand and body tracking, eye tracking, Natural Facial Expressions and fit adjustment features

Purpose: To improve and further personalise your experience

Users of Meta VR Products that choose to share additional data with Meta

Purpose: Providing a unique device identifier for personalised advertising

Legal basis: Our legitimate interest to provide an attractive platform for developers and advertisers, and the legitimate interests of advertisers, developers and other partners to help them understand their customers, show advertising, and improve their businesses.
