Meta Credits Terms

These Meta Credits Terms (“Meta Credits Terms”) apply to your purchase of, access to, and use of certain digital tokens (“Meta Credits”) that we may make available to users of certain Meta Platforms Technologies Products (as defined here) (“MPT Products”) and are between you and Meta Platforms Technologies LLC ("Meta Platforms Technologies", "we", "us" or "our"). These Meta Credits Terms do not alter in any way the terms or conditions of any other agreement that you may have with Meta Platforms Technologies, LLC and its affiliates, other than with respect to your purchase of, access to, or use of Meta Credits.

You must be at least 13 years of age (age may vary by region) to purchase Meta Credits. If you are a parent or guardian purchasing Meta Credits for a child aged 10 to 12 (age may vary by region), you agree that these Meta Credits Terms apply to your child’s access to and use of Meta Credits. References to “you” in these Meta Credit Terms also apply to them and their use of the account you created for them.

Your access to and use of Meta Credits is subject to: (i) any terms and conditions applicable to the MPT Product associated with your account, including the Meta Terms of Service, the Supplemental Meta Platforms Technologies Terms of Service (the “Supplemental Terms”), the Avatars Store Terms of Service, the Meta Horizon Store Terms, the Community Payments Terms, and any other applicable Meta terms and policies (collectively with the Supplemental Terms, the “Additional Terms”); and (ii) any limitations or restrictions applicable to the MPT Product associated with your account, including age restrictions and parental supervision controls. Your purchase of Meta Credits may also be subject to additional terms, depending on the applicable platform and the payment method you use.

ARBITRATION NOTICE: PLEASE REVIEW CAREFULLY THIS NOTICE AND REFERENCED TERMS WITHIN BECAUSE IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT. EXCEPT AS OTHERWISE PROVIDED HEREIN, IF YOU ARE LOCATED IN THE UNITED STATES, YOU AGREE THAT DISPUTES BETWEEN YOU AND US OR OUR AFFILIATES ARISING OUT OF OR RELATED TO META CREDITS OR YOUR USE THEREOF SHALL BE RESOLVED IN ACCORDANCE WITH THE DISPUTE RESOLUTION PROCEDURES IN THE SUPPLEMENTAL TERMS INCLUDING BUT NOT LIMITED TO THE ARBITRATION NOTICE AND DISPUTE RESOLUTION SECTION OF THE SUPPLEMENTAL TERMS. FOR THE AVOIDANCE OF DOUBT, THE DISPUTE RESOLUTION PROCEDURES IN THE SUPPLEMENTAL TERMS SHALL APPLY TO ALL ASPECTS OF ANY AND ALL DISPUTES ARISING OUT OF OR RELATING TO META CREDITS OR YOUR USE THEREOF, WITHOUT EXCEPTION.

  1. Meta Credits are digital tokens that you may purchase from Meta to access or interact with certain digital content or digital goods made available on certain MPT Products. The parent or guardian of a child ages 10 to 12 (age may vary by region) may purchase Meta Credits for their child's use. Meta Credits are not a currency, donation, security, or crowdfunding tool, have no cash or monetary value, do not earn interest, do not constitute a cash account or represent a cash equivalent, are not redeemable for any goods or services outside of the MPT Products and, unless you are a creator who is eligible for a revenue share pursuant to an applicable agreement with Meta, Meta Credits are not redeemable for any sum of real-world money or monetary value. Meta Credits do not entitle you to any profits, interests or pool of underlying assets, nor voting rights in any legal entity, corporation, partnership or similar. You may not sell, trade, transfer, or barter Meta Credits, within or outside of the MPT Products. Meta Credits are for your personal use exclusively within MPT Products, and you agree that you will not attempt to use Meta Credits for any purpose other than those purposes we expressly permit and enable within the MPT Products. Additionally, depending on your jurisdiction, your interaction with Meta Credits may be subject to certain limitations on purchases, redemptions, availability, and functionality, including, but not limited to, value and spend limits on an account-by-account basis and across your MPT accounts.

  2. Except as required by law, all purchases of Meta Credits are final and non-refundable. All redemptions of Meta Credits for content or features are final. The content or features that you access or interact with through or in connection with Meta Credits are not redeemable for cash or any other form of consideration and have no value outside of the MPT Products. Notwithstanding the foregoing, Meta Credits may be available for purchase via certain authorized third-party payment services; to the extent you purchase Meta Credits via such a third-party payment service, you may be eligible for refunds pursuant to the applicable terms for such third-party service.

  3. We may change (i) how Meta Credits are made available, purchased, accessed or used; (ii) the purchase price, or redemption or other value of Meta Credits; or (iii) we may stop offering Meta Credits, at any time at our sole discretion. Meta further reserves the right to update these Meta Credits Terms from time to time by notifying you of such updates by any reasonable means, including by posting the updated Meta Credits Terms on our website. Any such changes will not apply to any dispute between you and Meta arising prior to the date on which we posted the revised Meta Credits Terms incorporating such changes, or otherwise notified you of such changes. The date referenced in the “Last updated” legend above indicates when these Meta Credits Terms were last changed. Your continued use of Meta Credits constitutes acceptance of those changes.

  4. Your Meta Credits are associated with the profile you use to purchase them, such as your Horizon Profile. If the parent or guardian of a child ages 10 to 12 (age may vary by region) purchases Meta Credits for their child’s use, the Meta Credits will be associated with their child’s profile. If you delete your profile(s) or if your profile(s) is terminated for any reason (including reasons unrelated to Meta Credits and/or these Meta Credits Terms) on any MPT Product, you will forfeit any unused Meta Credits associated with that profile, and those Meta Credits will not be reinstated if you create a new profile on the relevant MPT Product.

  5. We may give you, or you may receive, promotional Meta Credits. Promotional Meta Credits may only be available to you for a limited time and may be subject to expiration and other additional restrictions or limitations. Promotional Meta Credits will expire on the date expressed in connection with the promotion or at the point of issuance. If no expiration date is provided, Meta Credits provided as part of a promotion will expire twelve (12) months from the date they are posted to your account. Upon expiration, promotional Meta Credits will no longer be available and will not be refunded. We may automatically apply available promotional Meta Credits to your use of Meta Credits.

  6. Meta Credits are licensed, not sold, to you. References herein to “sale,” “paid,” “purchase,” or “receive” relate solely to obtaining a license to access and use Meta Credits on certain MPT Products. By purchasing a license to one or more Meta Credits, and subject to these Meta Credits Terms and the additional terms and conditions applicable to the MPT Product(s) associated with your account(s), and solely for so long as you are permitted by Meta to use the Meta Credits, you receive from Meta a limited, non-exclusive, revocable, personal, non-sublicensable right to access and use such Meta Credits on certain eligible MPT Products. Upon redeeming one or more Meta Credits in connection with accessing or interacting with certain content, your license to such Meta Credits terminates and those same Meta Credits cannot be used to access or interact with other content. Meta Credits that you purchase from Meta will not expire, however your license to such Meta Credits may terminate if Meta decides in its discretion to stop offering Meta Credits.

  7. We may monitor (including on a continuous basis) and use signals to identify potential abusive or fraudulent behavior and to audit your compliance with these Meta Credits Terms and applicable law. If we determine, in our discretion, that we have detected any of those signals or non-compliance, we may restrict, suspend, or disable your access to or use of MPT Products, including terminating your Meta Credits or your ability to purchase, access, and use Meta Credits.

  8. You represent and confirm that you will comply with all United States, United Kingdom, European Union, and United Nations trade sanctions law (“Sanctions Laws”) in your purchase and use of Meta Credits. You represent and warrant that you are not prohibited by Sanctions Laws from purchasing or using Meta Credits and that you will not use Meta Credits in a manner that could violate or reasonably cause Meta or another third party to violate Sanctions Laws. If you are prohibited from purchasing or using Meta Credits under Sanctions Laws, agreeing to these Meta Credit Terms does not represent entering into an agreement with Meta or authorize you to use Meta Credits; even if you agree, these Meta Credit Terms are null and void. In making this representation with respect to Sanctions Laws, you represent and confirm that none of: (i) you, (ii) any of your affiliates, (iii) any other person having a beneficial interest in you, or (iv) any person for whom you are acting as agent or on behalf of in connection with these Meta Credit Terms is: (a) an individual or entity that is the target of economic or financial sanctions and export controls including, but not limited to, those administered or enforced by the United States, the United Nations, the European Union or any of its Member States, or the United Kingdom, or (b) an individual or entity organized, located, or resident in a country or territory that is the subject of comprehensive country-wide, territory-wide, or regional sanctions (collectively, a “Sanctioned Person”). You agree and acknowledge that Sanctioned Persons are not eligible to purchase or use Meta Credits.

    You agree that Meta Credits are Meta’s property and that you have no rights or interests, vested or otherwise, in Meta Credits unless and until Meta confirms your eligibility to receive Meta Credits under applicable laws. Without notice to you, and without liability to us, Meta reserves the right to suspend, deactivate, limit, void, terminate or cancel your Meta Credit balance or access if Meta determines, in its sole discretion, that you have violated these Meta Credit Terms or that your use of Meta Credits is unauthorized, fraudulent, unlawful, or otherwise risks causing Meta, you, or any third party to violate applicable laws.

  9. Some creators on the MPT Products may earn money from the Meta Credits used to access or interact with their content. For Meta Credits purchased and used, subject to and only in the event the applicable creator has completed the payment enrollment process and is in compliance in all respects with the terms of any and all agreements between Meta and such creator, Meta may pay to such eligible creator a revenue share less certain deductions. We do not guarantee that any creator will receive a revenue share.

  10. Meta Credits are part of the “MPT Products” under the Additional Terms, and your use of Meta Credits is deemed part of your use of MPT Products. In the event of a conflict between these Meta Credits Terms and Additional Terms, these Meta Credits Terms will govern with respect to your purchase of, access to, and use of Meta Credits, solely to the extent of such conflict.

  11. You hereby acknowledge that the terms and conditions set forth in the Supplemental Terms apply to your access to and use of Meta Credits across all MPT Products. Such terms include, but are not limited to, (i) your and Meta’s agreement to arbitrate any disputes related to these Meta Credits Terms; (ii) your indemnification obligations; (iii) Meta’s disclaimers; and (iv) limitations on Meta’s liability.

  12. You agree to pay all charges incurred for Meta Credits by you or on your behalf, at the prices in effect when such charges are incurred. If your purchase is subject to any type of use or sales tax, duty, or other governmental tax or fee (“Taxes”), then you may be charged for those Taxes. You are responsible for any Taxes due with respect to your purchase of Meta Credits.
